Important Information for Coke Oven Workers

Following a recommendation from the Secretary of State for the Department of Work and Pensions, supported by the Union 'Community' as well as the wider Trade Union movement, Parliament has taken the decision to amend the Social Security Regulations and add 'Lung Cancer for Coke Oven workers' to the list of prescribed industrial diseases. A prescribed disease or injury is one which is recognised by the Secretary of State to have been caused by a person's occupation, leading to the individual being able to claim an amount of Industrial Injuries Disablement Benefit, depending on the severity of the condition.

The change will enable any Coke Oven worker who contracts lung cancer after the 1st August 2012, and who meets the criteria outlined in the Regulations, to make a claim for Industrial Injuries Disablement Benefit.

In the first instance members should contact their local Job Centre Plus to make the initial inquiry regarding any claim.

The amendment does not affect an individual's right to pursue a personal injury claim against an employer, if it can be shown that the employer was negligent in causing or contributing to the illness.
